They got sued for this many years ago for millions of dollars. Dentist bought a car and later discovered the car was painted fully.
BMWNA v Gore. In 1990 Gore discovered his "brand new" BMW had been repainted and received $4k in compensatory damages and $4M in punitive. The punitive damages were found unconstitutional by the Supreme Court in 1996.
This, like the McDonalds coffee lawsuit, is another case where corporate people skills would have prevented all sorts of crap for a lot less hassle and money.

Since the lawsuit I mentioned above, BMWNA apparently gives your dealer a statement of all repairs made, which they are supposed to show to you. I think the repair limit is $7500...

That would truly suck...I wonder what that does to my spot on the M3 list?
If your car was not on that ship, it shouldn't do anything. I'm almost positive that whoever those cars were going to, will be able to reorder at some point, but I doubt the dealer's going to knock every person down on the list because of this. Furthermore, the 2nd batch of cars has at the very least already begun production, therefore many would not be getting the car they specced. In the end, it's all up to how each individual dealer wants to handle it.
If your car was on that ship, well, I'd call your dealer.
