Ferrari silent on odometer tampering?
There are a lot of moving parts to this story, but it sure seems like it would be hard for Ferrari to deny they knew this was happening... I mean, the tool pings the server in Italy when the operation takes place! More details on the HP.

We'll see where this all goes. There are probably legitimate purposes for why you'd need/want such functionality, but the potential for abuse clearly exists.
Ferrari, however, has somewhat of a history of "ethically-challenged" conduct.

Ha ha, "ethically-challenged" is one way to put it. But the Feds could get involved here, which might prove troublesome. That's not exactly like being jerks to prospective customers.

I agree that this is more serious than playing favorites with "The List." It's essentially, if undisclosed, committing a fraud. We'll see, though, if this has any legs. My guess is the suit goes nowhere, but there's always the potential a prosecutor wants to make a name for themselves.
