In CA, they won't make you pay, they might fight you on it, but telling the adjuster that you are calling the insurance commission or the AG usually works. The best case is sub, since adjuster from your insurance will usually work with you and won't mind the good shops.
Either way, they can't make you pay in CA, it's the law. You have the rights to the shop of your choice.
well, you pose a good question - the answer to which i am not 100% sure of. the only thing i know is that the high end shop that i keep referring to told me that their customers commonly pay out of pocket to have their cars fixed with them.
see the insurance/customer contracts in IL state that the insurance company has the right to either utilize "used" or "non OEM" parts on your car. only if they cant locate one of these "non-desirable" parts would they use the OEM parts. of course if the price is the same they couldn't care less but that is usually not the case.
also, i am told that much like with medical insurance, if shop A takes insurance company B, then shop A effectively has to accept whatever rate insurance company B agrees to pay them.
shops that dont conform to the above either dont take insurance, OR take insurance and bill the customer the difference.
here is one example: during the accident i refer to, i had relatively minor cosmetic damage to the front end of the car. the final work ended up being somewhat less than $3,000. I paid about $150 more out of pocket on top of my deductible because i wanted OEM parts (well one part - hood, all else was kept the same). the high end shop i refer to quoted me well over $4k for the work and told me that they will not agree to the insurance's price so i would be responsible for the difference.

you CAN go anywhere you want. but i dont think they are obligated to pay 100%.

Anyone know where I can find the legal statue where the insurance don't have to pay 100%? Basically my body shop wants XX amount and Geico is only paying $40/hr which is the same labor rate as a KIA.

I wouldn't bother. Never have them pay the shop. Just get a quote from the dealer for the damaged parts, and a quote for the body/shop work required, and submit that to the adjuster. If they won't cut you a check for that amount, tell 'em your lawyer will be in touch.

the only issue with that is that you may cheat yourself big time if there is some undercarriage work that needs to be done.
i dealt with something similar in the past on my mom's car where the initial estimate came in at like $5k. by the time they were don replacing the entire suspension and some other stuff the final bill was $16k+. obviously they would have been on the hook for the rest BUT, if available, they would have used the cheapest parts available/possible.
but again, at least in IL, their contract specifically states that they are allowed to use non OEM or used OEM parts. that in itself can run 50% plus difference on parts alone and your lawyer will not be able to do anything about it (i would think).

The car is at Manhattan Motorcars (Porsche Dealer) being repaired now for bodywork only. Her car got scratched up pretty bad. Geico is saying that Manhattan Motorcars estimate is unfair because they wanted more than Geico's $40/hr labor rate....

I have Geico, but I never used them to get a car fixed. my only experience with their customer service was about 5-6 years ago I had just leased a new Jetta, and it got totaled in a double at fault/no fault accident (environment). happened at 8:45PM, by 11AM next day the adjuster was out looking at the car. I had a check in 3 days. yes, I made money on the car, after my deductible. I also like the fact that you can get a real person on the phone, no matter what time of night or day.

worst insurance company ever. my car got broken into and all the stereo and stuff inside the car got stolen. they didn't cover ANYTHING because it was aftermarket. even with reciepts. i bought extra coverage but they said that it didn't cover it. i cancelled. 21st century ftw.
I'm not in the habit of "bashing" other companies, however as an independent insurance agency owner I have had a fair amount of experience with geico. I have had several clients of mine that were involved in accidents with geico insured's. Their customer service experience has been very poor. The company is quick to deny any culpabilty/claim even when their insured is at fault. In addition, the claims process takes an inordenant amount of time to settle.

I have full coverage with Geico. My first claim was when a 98 year old D-bag t-boned me...Not much damage but cost me $1800 at my local body shop...Geico gave me $6000 so I got to pocket the rest. 2nd time my car was vandalized. The actual price to fix was $900, Geico gave me $3200 so needless to say I am very happy! Both cases have been determined to be zero % at fault therefore my rates did not increase.
I've found their customer service to be great thus far but haven't gotten into any accidents or anything so can't say anything in that regard.
They were great in dealing with even with mods...Had them insure a good amount of parts from my GT700 car.
