Rear arse collision
Yes and no. In California you need to have a Full Replacement clause in your policy or they give you "fair" market value.
Sorry I should have been more clear, that was typed on my phone.
Full Replacement clause is for getting you a brand new replacement. When I say replacement cost what I meant was the cost to replace the exact car you had, e.g. fair market value plus taxes and fees.
The insurance company will most definitely try to screw you here by telling you that your car wasn't worth very much because of age, miles, condition, etc. Documentation showing the condition of the car pre accident is important, and find a bunch of "comparable" cars listed for sale somewhere. This is what an independent adjuster would do.
You can hire an independent adjuster too, they charge a couple hundred bucks.
I previously had a Honda S2000 which was rear ended. I successfully got about $8000 in diminished value claims from the insurance company, and the car was not written off.

Just got the settlement check last week. Anyone got a great deal on a GT3?
