Won ebay auction at 55.1K for GT-R, Honda of San Marcos refusing to honor

Won ebay auction at 55.1K for GT-R, Honda of San Marcos refusing to honor

I won eBay auction item number 220823902975. I spent hours to watch this auction and won it at $55,100 sunday afternoon. As soon as I won I sent a email asking how would I make the deposit for the car. Monday Morning I called since I did not get a response. I talked with a Chelsea who took my call at 10am today (8/8/2011) I ask to speak with their internet sales person which is Randy. She tried to get me to Randy and finally said that he is there but refusing to take my call. I left a message with her to let him know that I am the winner of the auction and want to make the deposit and arrange pickup date. A hour later another guy called me said they are not going to sell me the car as Randy made a mistake and is out of town when earlier I was advised he was refusing my call and he is there. I advised I was unhappy that they are not going to honor the price and asked to speak to someone higher. He directed me to Ian at 512-392-1313. I called Ian and he said that they are not going to sell me the car for the price I won it at and if I want the car I will have to pay the price their asking of $59k.

I feel as what this dealership is a violation of Consumer Protection laws.

So far I have reported this to BBB, Federal Trade Commission, Texas department of motors, Texas's attorney's office.

I forgot to mention I called eBay and they said that the dealer has violated their rules. One they did not list the car with a reserve nor did they say that they have the right to sell the car to anyone or cancel any bid. So I filed a eBay claim as well.

For the price difference, its probably not worth fighting. You'll spend that much or more in time, effort and lawyers fees. For all practical purposes, the best case is you'll give them bad feedback. They'll probably just shut down that account and open a new one on ebay.
Good luck, though. I hope they come clean and honor the price.

Ya. ****ty that they won't honor the price but as mentioned before. You'll spend more time arguing with them than it's worth. If you really want the car I'd just pay the $59k price and be done with it. You've already reported them to the appropriate organizations, you can leave negative feedback as well on their account which may dissuade future bidders but all in all, not much you can do if they keep refusing to sell it. Good luck with whatever you decide to do though! Looks like a good deal regardless.

They made a mistake and won't sell it. Move on. Publish this on every Honda and NIssan forum, yelp, etc. They screwed up and I dont think you'll get more from them. Typical dealer BS.

Wow Randy wouldn't even take your call? Someone take his man card away. He was scared to talk to you and knows full well that an eBay winning bid is a legally binding contract.

Not even worth the time. They have 1 feedback and will just open a new account. If they don't want to sale it just move along and you'll eventually find something better.

why not propose to meet them in the middle? it was an obvious mistake at that price and $55k is still a good deal for you and they'll still make money.

EDIT: read wrong. thought you won at $51.
