Desperately need advice. Just spent $48k on car that died 50 miles down road
Not Correct ,Under the provisions of the Magnuson-Moss Warranty Act of 1975, an automotive dealership/carmaker cannot void your warranty because your vehicle has been modified with aftermarket parts. They (the manufacturers) have to prove that the failure was the direct result of the installed aftermarket part. Unfortunately, too many folks have gone to a dealer to have warranty service performed on their modified vehicle only to have the dealer refuse to cover the defective items. The dealer usually states, that because of the aftermarket parts installed, the warranty is void (without even attempting to determine whether or not the aftermarket part caused the problem).
Just to beat a dead horse...
While a WARRANTY is subject to M-M, and "extended warranty" is not a 'warranty'- it is actually 'mechanical breakdown insurnace' or a 'contract to fix your car'... all the extended warranties are NOT subject to MM.
So, an aftermarket warranty- or even a porsche extended warranty CAN specify that ANY modifications- causal or not- can void warranty coverage. DO NOT confuse this with the fact that MM prevents this with original warranties.
Having said this, some extended warranties are silent on mods (rare); some state that the mods must be a cause of the failure to be excluded (common) and some say 'any mods' void coverage (rare). Guess what? You must READ each policy to understand it.
Finally, when I read someone say "Oh, they have to prove the mod caused the falure' or 'the burden of proof', I just laugh. This is by people that never had to pay for litigation. When faced with a $25k claim, you will get denied...the company calculates that for every 100 they deny, three go to trial- one settles, on goes to decision, and one they win.... a financial win overall for them....
A
im sure its happened before but its certainly not common and i wouldnt let this one case put me off making a purchase
Sorry to go off topic, in my view unless you know these cars very well or have very deep pockets i would and did confine my search to a stock car. I have owned many high performance cars and have never (yet) gone wrong with a stock car. By stock i mean no performance related or engine modifications.
Also I would have contacted a performance shop preferably the one that did the mods to verify if every thing is in order (PPI)...
I do feel sorry for the OP for having such a tragedy buying his dream car... Hope things work out for him?
Exactly... However buying a highly modified car is always a gamble! Knowing who owned it, where the modifications were done, how was it maintained (prefoessionally or DIY'er) and going thru the service records is a must when buying any used car let alone a modified car.

i keep a file folder with every receipt and document everything i have done to my car, i'm surprised everyone else doesnt do the same, doesnt cost anything and makes selling the car easier, also makes life a lot easier for the buyer
Ok not sure of this but if this is Sean's old car then Yes he had a fully built motor. If this is Tim's (colorInc)old car then yes as well this was a Built motor as well. Other then that those are the only 2 cars that i know about in Michigan that were for sale at one point and were in the price range but again i'm not sure if these are either one.
