I'll tell you a story, my old c4s got lightly tapped one morning in rush hour traffic by a guy who got rear ended (very minor), my car had zero damage, not even a scuff on the bumperette. The cops told me I could go, my insurance was never involved, no police report, nothing. Fast forward three years when I got rid of the c4s to get the turbo, carfax turns up an accident record for my car. I ended up taking it jailhouse style on that one. Call a lawyer.

I am currently using them to help me go after diminished value on my claim. They are very knowledgable and provide expert testimonials for you to get the money you deserve. They just faxed over the reports to the insurance company today.

Your insurance company will try to screw you on this as well- it is in their best business interest to not help ANYONE, even their insured customers, since they may be on the receiving end later. They'll all say 'not covered, sorry'

I really don't know what I would be besides being devistated. I love my car and drive the hell out of it, but I am alway on the look out watching my rear end and every angle to make sure I have an exit strategy. There are way too many idiots on the streets these days specially in SoCal...

I know that you just bought the car...but if they're saying that you can't be reimbursed for diminished value until you sell the car, then I'm thinking that you should sell the car. Then get them to pay the difference (including sales tax). I don't know if this would work, I just made it up.

The link I posted has such a scenario- the insurance company insisted that it was not diminished and the insured (ie owner) said 'great, lets sell it and you pay me the difference in value (between book and sale)... They insurance company ate big money.
