We all take this chance everytime we go out and it does suck. I think the guy should have to return the car to a pre-accident status. That being said with no police involvement and no insurance info you are now at the mercy of honesty. Hope it turns out. Keep us posted.

 

Get a police report made now so that when the estimates are high and he changes his mind you still have it on paper for the insurance. In NY you have 10 days to file one so check laws in your state.

 

Nothing sucks worse than a hit & run...unless you're in SF where the cops won't even come to the scene of an accident unless there's an injury or a car is blocking the street and needs to be towed, so forget about ever getting a police report.

A few years back, I was stopped in rush hour traffic here and a bus hit me from behind. I stopped the bus and got the insurance info, etc when a cop pulled up and asked me if I was aware I was blocking traffic (double parked). I asked him if he was aware I was hit by the bus and if he would write a report...nope, he wouldn't do it. Later, it turns out the bus driver said I ran into her (their insurance guy said I would have had to been driving backwards given the damage if she was to be believed)! It turned into a big hassle (which wouldn't have been the case if the cop did his job), but I finally collected the money I had already shelled out to fix my car.

Too many people out there that will lie, cheat & steal if you give them the chance...

Just for closure... It took me 4 months to get paid from him. Next time, I get insurance and a signed statement at the scene or I call the cops. Simple as that.

Brings to mind when I got rear ended years ago and the driver produced an invalid insurance card and I got paid 2 YEARS later after I took him to court.
