This link is all over auto boards. It's about a BMW dealer in SoCal...

The guy ended up getting a 996tt.

Wow,
That is terrible, what a headache.
I'm happy to see the guy made out alright in the end.

I think maybe if he would have approached the owner a little bit different such as a lawyer not present at the first meet, things may have been a little easier. I would have gotten my insurance company in on this and let them sue his insurance company for a totaled Bimmer. I know it would have been hard not to bring a lawyer on the first meet but, that sort had got things really heading toward a really screwed situation. I would have had the owner of the dealer fire the guy who trashed the car if he had not already. I'm sure the dealer's owner would have maybe not have taken the defensive posture from the get go if the lawyer wasn't there at the first meet.

It's a hard call with the lawyer stuff. Growing up in CA (and hoping to ge back asap) it's usually your first reaction because of all of the lawsuits and CYA living there (someone is always trying to sue when there is a problem, no matter how small). It's very unfortunate but reallity there, people are always looking for the quick payday.
I just read the post for follow-up and it's interesting to see how fired up people are and how many other boards it's hitting.
Some pictures of his new car are posted and he ended up with a new yellow TT.

A well deserved public relations nightmare for the dealer IMO.
