According to CVC if a car makes a left turn in front of you and causes a collision he/she is at fault. SINCE, it clearly states that one must make sure the roadway is clear before making a turn...... This means even if you blew threw a yellow light doing 50 in a 35.....
Don't let them try that number, they have a driver "at fault" and are trying to save money.....
DON'T LET THAT HAPPEN, If it was really your fault do you think they would be making such an offer? Let them know you'll take them to court, try to speak to as many of them over there, supervisors, managers etc. So if you need to go you can drag all their happy asses in for a court trial...

This is going to be like anything else in our world. The people you complain to will always say 'NO' and it is up to us to fight for everything that we want. They bank upon the fact that the majority of the people will give up after a few attempts and move on, taking what they were offered. Only those that hold their ground and stand up for what is right will get it done right. But it WILL cost you time and effort.

If the police report is clear that you did nothing wrong, I don't see why your company doesn't go after theirs to get it covered 100%. I don't see the problem here.

I would get a lawyer. The other guys witnesses mean nothing. The police report and the ticket given to the other guy means everything. Can they prove you were speed at the moments before the crash. NO!!!
As for Allstate I've never had a problem with them. The thing is get 2 estimates from reputable shops associated with 2 dealers. The worst thing to do is take your own insurance company adjuster's 1st estimate. He is not a porsche expert and may not know what potentially lies underneath. He may put in "refinish" or "refurbish" on a part that the body shop knows can't be fixed correctly in a car like this. Then pick a body shop and have them discuss it with the adjuster.

So basically if you have ALLSTATE and drive a porsche or any type of car over $40,000 I recommend you get different insurance because they refuse to pay what it costs to properly fix a porsche. Anyone ran into this problem i need help?????????????????
Sorry to hear your problem just get it fixed where they want it fixed and sell the car after wards.
I recently had a situation very much like yours where my car was hit by a careless driver. The driver who hit me was judged at fault by the police report and thus began my oddessy with my 996 and the insurance company.
As it turns out, the driver of the car who hit me was not driving his own car but someone elses and the car did not have sufficient insurance to cover the damages of my car (nor the other car he hit). This is where my experience differs from yours as I filed a claim with my insurance and took the car to the premier body shop in my area. The car was judged after the initial inspection to have 11k in damages by the Allstate inspector. I wouldn't worry about this as they cannot see the structural damage until the car is dissasembled. The total was much higher, somewhere in the range of your car 33K+. Well the car was totaled and we had 3 weeks of negotiations on the value of my car.
All of this when the person who hit me was at fault. My insurance company (Happens to be the same company as yours) is now going after the owner of the car who hit me. I'm not sure why they are not doing that in your case as the other driver was ruled as at fault. I would try to have more conversations with your insurance person handling your case and determine if they are going to go after him or is it some reason based on your states insurance laws that they going down this path.
As I recall, you have the ability to take your car to any shop you choose.
If the initial contact fails with your insurance company, get legal representation. As I'm sure you are aware, if your car is repaired, even if it's right, you still have to deal with diminished value of your car due to the accident. That can be a fight too.
I'm sorry for your misfortune as it's not a pleasent experience. Trust me, I know.

The other driver is at fault. I don't think the other insurance company can prove you were speeding, and it is not on the police report. The other insurance company should pay for everything. Make your insurance company fight for that, that is what you have been paying them for all this time.
In FL we can take our cars anywhere we want to. I just went through that, and when they said "but that place is the most expensive in town", I said "there is a reason for that, they are the best, and that is what I expect". Case closed. Stand firm on this.

but the way i would handle this is get your car fixed at the shop YOU want it fixed (insurance companies must honor all repair shop estimates) and what will happen is after that allstate will usually go after the other person's insurance company for payment (since he is respondsible for the accident). i don't not believe you need to contact the other person's insurance company and get funds from them, usually the insurance companies handle that. just my 2 cents.

I was in an accident that may be similar to yours where a car ahead of my pulled into my line and hit me. She was sighted for failure to yield and determined to be at fault. In an attempt to get out of it, she said "he must have been speeding because I didn't see him"(I was in her blind spot coming to a red light at about 15mph
) The officers responce was that even if I was speeding, it would not change who was at fault for the accident, it may have been associating factor, but not the cause of the collision.

I've never had a problem with Allstate I've had them since I first started driving and have been in more than a few. I wouldn't worry. They are a big company and all you have to ever do is ask for a supervisor as you would in any other company and the customer is always right...
