Need some help/advice...Diminished Value/Loss of Use

Need some help/advice...Diminished Value/Loss of Use

I am looking at a claim for diminished value and loss of use on my accident. So far, State Farm (the lady who hit me and I both have State Farm) has been "pleasant" to deal with...until I said the words "Diminished Value" and "Loss of Use". Has anyone ever had to deal with their insurance company on these topics? And any sage advice on how to proceed? I really appreciate any help you can lend. I don't mind obtaining an attorney, but if I can avoid this, I'd like to.

I'am not a lawyer but I think diminished value would be hard to prove, it's subjective, also I think you would have to prove that loss of use caused you some kind of hardship. what did your agent say? You should check with an attorney.

Had the same problem with my TT. Got rear ended to the tune of $12,000 damage. Hired an attorney to get diminished value and got nowhere. Had I owned the car, there would have been a chance of DV. However, I leased and the insurance company said that Porsche Credit would suffer the loss, not me. All I have to do is turn the car back in at the end of the lease and since the damage did not exceed 25% of the car's value, I can walk away. Legally, Porsche is the real loser in terms of financial loss. I went to Kelly Blue Book's site and entered my car with and without damage. The resale was $6,000 lower as a repaired vehicle. DV restitution is possible. It's just harder to claim on a leased vehicle. We're still going at it after over a year.

State Farm is the best insurance company to deal with. You may get something. I would give to a try. If it was anyone but State Farm I would tell you not a chance in hell.

You are entitled to diminution in value. You will have to be firm and push the carrier, State Farm. I strongly suggest that you contact a recognized expert, usually your local Porsche dealer, and have them examine the car before it is fixed. They will probably give you a before and after valuation, and it has been my experience that the amount is substantial. Further, take photographs of the repairs as they progress.

did u suffer any physical harm from your accident like, whiplash etc.? bec. u can also get compnsated for your pain and suffering?

if you did, i know of a good lawyer that specializes on personal injury & automobile accidents.. i can give them a holler regarding diminsihed value etc.
