To no suprise, its totaled. Progressive is my ins. carrier and being polite, proactive and willing to settle this asap. They are asking for any upgrades on the car and for price/dates added.

I bought the car from the dealership with the aero kit, techart wing and GT2 front bumper. It also had the alluminum "Carrera" door sils, arctic silver trim pieces and white spedo/tach faces.

I dont have their first offer yet, so I dont know how hard I need to work on this, but what can I do to make sure I get the most out of this? I know "Replacement Cost" means one thing to me, and probably another thing to Progressive. The towyard guy reminded me about an important thing most people forget, to finish all your negotiations on the final number and then before you sign the paper work, remind them to add on the state tax you will have to pay when you replace the vehicle.

If its totaled, who gets to keep the car? I know they want it for parts, but if its a total loss, do I have any right to keeping it/parting it out. The interrior and entire front end is still perfect. Anyone know my rights here? There are a TON of mint parts you guys are welcome to if someone can coach me through this...

Saw your pix in the other thread -- glad you're okay!

The short answer is that in exchange for the check they are going to give you, the insurance company is going to take the title to your car. They will want to sell the car -- the whole thing. As part of the settlement you might be able to talk them into swapping some of the upgraded parts for stock parts if you still have them. They will of course factor that into the value they give you and reduce it. I don't think they would be happy receiving your car, for instance, without wheels on it.

Sit down and make a list of everything you put into the car and what it cost and give them that list. Good luck!

Oh, one more thing...

Do you homework by finding every comparable car for sale in a 100-200 mile radius. Try to see what's on them, option wise. Then add to their prices the cost of the options your car has that they don't -- have like the Techart stuff, etc. Give that list to the insurance people, too.

There, I think my advice so far has earned me at least one valve stem!

First off I am glad you are ok. Second, I believe you have the right to buy back your car from your insurance company. Dont let the insurance company bs you. Maybe an attorney can chime in here.

Did this before. As for rights.. you don't have any other than what you negotiate. They are paying out for your car so the ins company will own it not you. You can negotiate to buy the wreck from them and keep a check for the difference but that again is up to you (probably not worth your time). But if you have your heart set on some cherished item that you upgraded in the car and they feel like you taking it out doesn't effect the value they will get from the junk yard then it is all good.

I was able to retreive my head unit, amp and MB quart speakers out of a totalled 911 and they could have cared less, in fact I was a bonehead and only asked about it after I had my check in hand and they were still ok go get whatever you want from the stereo. Now if you wanted to rip out the susp, engine, trans, seats then that is another story altogether.

Insurance stuff

I deal with Insurance companies daily- I am an attorney! If you have a replacement value clause, you get the same car as you had, or as close as possible. If you had aftermarket parts and receipts, those should be added to the check. And you should get two offers from the company- one with and one without Salvage value. If you choose, you can keep your wreck and get a smaller check. That choice is yours!

The car is still yours, even at the tow yard. If the tow yard folk won't let you have access to the vehicle, call the insurance company and demand that the car be moved, to your home or wherever.

Good luck. And glad you are not hurt- no money is enough to take away the daily pain.
