Hello,
DOES ANYBODY KNOW A LAWYER WHO CAN REPRESENT ME?
I had an accident in Utah, March 9, 2023. USAA did nothing to bring my car back to California and I lost my cell phone in the accident. I could not contact a claims representative in over 2 months, so I filed a complaint with the State of California Department of Insurance.
The repair shop found damage of $136,000 and refused to fix my car after USAA paid them $19,000.
USAA sent a check, which I was unable to cash, 8 months later for $105,323 instead of the $164,498 settlement they stated. USAA paid the repair shop and I was told to hire a lawyer. They refused to communicate with me. There was over $20,000 damage from storage in their outdoor Total Loss Lot.
This is my first claim against my car since being purchased in 2010, over 75,000 miles ago.
My homeowner's policy was in effect since 1979, without a single claim. They cancelled my policy.
I need help getting USAA to fulfill their insurance obligations.
March 9, 2023 - Accident in Bicknell, Utah. I lost control of my car and hit another vehicle which was repaired promptly by USAA.
May 12 - I filed a complaint with the State of California Department of Insurance that USAA refused to do anything about fixing my car. File # 8521255 with the Claims Services Bureau.
June 6 - Notice from USAA that they are evaluating my claim.
May 16 - USAA doubled my auto policy premiums by increasing annual mileage to 35,000.
June 15 - I received a report from the State of California Department of Insurance. They were processing my claim against USAA. File # 8521255 with the Claims Services Bureau.
June 26 - USAA determined TOTAL LOSS SETTLEMENT.
June 27 - USAA claimed that their settlement of $164,498 was declined. I dispute this claim.
I inquired about the salvage value of the remaining parts, which remained after $136,000 damage and they said they were working on getting a final value. They failed to give me a final salvage value.
July 6 - USAA is still updating the valuation of my vehicle and sending a response to the State Department of Insurance.
July 13 - USAA notified me about my car being a Total Loss. They stated "a payment for $164,498.16 will be sent separately."
They also stated "The storage and teardown charges from Premier Coach Auto Collision have been settled in the amount of $19,188.00. We are still working on coming up with a salvage value for this vehicle."
July 18 - California Department of Insurance report on my car. They said USAA was conducting my claim properly!?
August 9 - USAA Total Loss Update - USAA failed to give me a choice to repair or not to repair. They placed a value of $59,175 for Total Loss Salvage parts.
November 12, 2023 - USAA sent me a check for $105,323 which cannot be cashed without my ex-wife's signature. The vehicle title states "or" not "and." I was shafted by USAA and Premier Coach when they falsely proclaimed my GT3 to be a total loss and refused to fix my car after letting it be vandalized in an outside storage yard for weeks.
Premier Coach refused to fix my car, so I had it moved to another repair shop who said they could fix it for $105,000. It will remain a total loss and never be worth half of the repair costs.
I demand full payment, which USAA promised (Total Loss Settlement, dated July13,2023 - $164,498) and payment for impoverishing a 79 year old for over 20 months.
