Attention fellow exotic owners!! Beware of the W hotel in Miami!!!!!!!!!!!!!
Read this on another forum too and thought about the repercussions of having someone charged with GTA, as many have suggested. Charges would need a VIN, which would be on the report. CARFAX and other reporting agencies would then have your car listed with that report attached. Something to consider. Don't know the laws in Florida but an "unauthorized use of a motor vehicle" charge wouldn't leave you with the extra baggage attached. If I was buying a car and I found out it had been "stolen"I would run the other direction as fast as I could.
Definitely communicate in writing. Make sure you demand that they preserve any evidence relating to this incident, such as the surveillance recording, security logs, and employee time/attendance records. Ask for a contact with corporate claims and insurance companies for the valet company and the individual drivers, and put everyone on notice.
Ritz in Chicago did the same thing to my Viper ACR, but they also side swiped a curb with it (bumper, wheels, etc). They wouldn't do anything about it.
If you're in the area, you can file a small claims action against them and get some news coverage of what the W actually does. You don't have any damages that will justify spending a few thousand on a lawyer (added miles, fuel and a full interior/exterior detail). They did take your car without your permission, so if you find out who was driving the car, you could file criminal charges.
