Or "Engaging in a speed contest"

I got that one back in the day and I DID NOT exceed the speed limit.....just jumped on it in 1st.........

AND

remember, just like reckless driving (or a dui for that matter) speed contest or exhibition of speed are all 2 point misdemenor violations....not a 1 point infraction like running a stop sign or unsafe lane change etc.

Damn! So what does that mean-- can you get it off your record? Do you need to hire an attorney?

No, it comes off in X amount of years (depending on your state) like any other ticket.......but you only get so many "Points" a year before they will suspend your license.....In CA it's something like, 3 points in one year or 5 points over 3 years.....exceed it and your license gets suspended. The dui's and open containers and such DO stay on your record longer tho.....

The cop had to cite a vehicle code section. Find a copy of the section and read it. They are usually very straight forward. You would be surprised, there are a few cops who BS their way around these codes. You won't really know unless you read it for yourself.

Actually I got pulled over for this years ago in a camaro. I fought it in California court and this was the answer and interpretation from the judge. There is no law telling you how fast you can get to the speed limit. HOWEVER if you spin the tires that is a exhbition of speed and ticketable. IF there are 2 of you then there is grounds again for exhibition of speed and ticketable again. So if there is no spinning of wheels or 2 cars in a drag race you should be able to win in CA court. I would however read your vehicle code and make sure. I am not a lawyer but I did sleep in a holiday inn express.

What is to keep the cop from saying you did spin your wheels when you didn't? Not that a cop would lie on the stand.

I've also heard it called "Excessive Display of Speed" . . . Just another form of generating Revenue for the State at our expense.

FUNNY you would say that.......

When I got THAT ticket it EXACTLY that.....I was sitting at a light and a hot rod of some type pulled up next to me....well I had a burnt clutch and couldn't have raced if I wanted. Light turns green and he takes off across the intersection and BANG the red and blues come on from across the street and we get pulled over and ticketed. In court the cop say she observed me "spinning my tires across the intersection"

Hmmmmmm

And my brother got a ticket for "Exhibition" cause he took off and made a left (jumped on it in first) and the cop said he too, was spinning his tires.....and he is now a COP. So he remembers it well........

Yes.

I did that Oct '04, and only got it to about 30mph and let off cause end of the gear, and cop pulls me over for "Racing on Highway" and all kinds of BS about how I was doing way faster than 30 when my car (at the time) can't do more than that in 1st. Didn't know he was behind me, but the other car had no clue what I was doing so....anyways it ended up with 3 months probation and 10hrs community service which I just ended up paying for both so I don't have to do either
