Well I'm a car dealer(Toyota, RangeRover, Cady) Firstly I would never take a deposit on a car comming in 6 years but if I did I would honor it. I'm sure he has a over sticker deal...And he's not going to get that many cars...You need to talk to the General Manager or the Owner, the sales managers are not going to help you. If you were planning on paying cash offer to finance it...It will allow the dealer to make a bit more...that might make him more happy. Let me ask y did y actually order this car, or is it a dealer ordered car.

Get them "CRAZY EYES" with them! That is completely unacceptable, and you should be able to use one of the salesman as a punching bag!

If a Porsche dealer took over MSRP on a new car and got caught, they would lose an allocation of that model. The car is probably sold at MSRP to a favored client, who'll put a little mileage on it, sell it back for MSRP or close to it, and the dealer can then flip the used car for over MSRP.

same BS happened to us with 2 m6s at braman of west palm.... we were supposed to get the second and third m6s,... i think they are now selling their 5th one....ours first one will be here in a month, so we backed out of the 2nd one. Its total BS and you cant really do anything about it. Dealers always have sketchy ways of "Acquiring" hot cars to sell at a premium...

i loved the excuses they came up with for why we didnt get ours yet.... totally pathetic. After buying close to 15 Bmws from them, we are considering dropping bmw because they are willing to make a bit of a premium rather than taking care of long-time, loyal customers.

Maybe I'm a jerk, but customer service and loyalty are my two biggest concerns when buying something, so I would not only send a letter directed to the GM and Owner of the dealership, but I'd also send a copies of the letter to BMW North America and the BMW factory. If you really have purchased close to 15 BMW's brand new, they'd have record of it and would be very upset about how you've been treated. If you told them that because of this experience and lack of appreciation of your brand loyalty and business, you will be not be purchasing BMW's anymore and will get either a Mercedes or Porsche, I'm sure they'll do almost anything to keep you as a customer. Obviously they can't give you the first one since it's gone, but they might give you some very nice options at no cost to make things right. If they do so, after giving away possibly thousands of dollars in options for free, the factory will not be too happy with the dealers practices. The Dealers are short sighted and only look to make the most money they can for the short term. However the Factory understands how important it is to have loyal return customers for the long term. If you've had say 13 brand new BMW's, you've spent hundredes of thousands of dollars with them. If you put it in dollars and SENSE (pun obviously intended) with them, I believe they will change their tune with you. Sorry for such a long post, but I HATE bad customer service and companies that take their customers for granted. I work in the Children's day camp industry and if we don't have good customer service, the campers will go somewhere else, thus leaving us without any business. Contrary to the saying the customer isn't always right, however in cases like these, they are ALWAYS right. There's no excuse for them to sell your car even if it's to a high profile customer such as a celebrity (which happens all the time here in SoCal). I know in all of that tiny print that you have to initial and sign but never read, there are clauses for such circumstances, but if they want you as a repeat customer then they better live up to their end of the agreement. This makes me wonder how many people are told they are the "first on the list" for a new model car. Ok, I'm done

If there is in fact a "written agreement" then it sounds like basic contract law. Is it enforceable? What are the terms, etc?

doesnt a verbal contract hold as much (theoretrical) validity as a written one when there are witnesses? regardless, im probably not gonna take action. Ive already said my piece to the salesman and the general manager. Its just annoying... and it sucks that i happen to live in a very wealthy area where people are willing to pay 50K over sticker for the earliest m6s. It also sucks that bmw makes a great product and its hard to get away from them even when they **** you over.
