Speeding Ticket
Kinda long story but hoping someone here can help me. I received a speeding ticket coming back from canada yesterday in Pattsburgh, NY (81 in 65). I live in Long Island and the appearance ticket is for 12/30/04. There is no way i'm driving up there.
We were a group of buddies taking two cars. I saw two troopers on the side of the road and they were facing each other bs-ing. anyways about 2 miles later i see one flying by. he pulls over my friend and tells him to stay put. then he pulls me over. he told us different stories that i was going 81 in 65 and my friend that i was going 83 in 65. my friend was asked to take a sobriety test at 1pm in the afternoon and he def. did not drink. both of us got tickets. i think this guy is banking that i don't show up. anyone recommend a good lawyer up in that area?

It has been a while since my last speeding ticket, but look closely at all the verbage on your ticket (front and back) and see if you see the words "nolo contendre." That means no contest. You can plead NC and send in the fine but you are not assessed the same way as guilty. Cheaper than a lawyer...

Under section 40519(b) of the Vehicle Code, a defendant is entitled to enter a not guilty plea in writing in lieu of appearing in person in front of a judge. This option allows you to mail a letter to the court pleading not guilty to the charge against you. In this letter, you can request a Trial by Written Declaration, allowing you to contest your citation entirely by mail.

What would your basis be for fighting the ticket? The fact that your friend and you are going 2-3 mph apart isn't going to help you.
If you weren't speeding or if the speed is grossly wrong, you have a case. If you are just trying to get out of a ticket, you can try writing and stating your case and see if the judge will lower your fines or dismiss it. I wouldn't count on it though unless you have a good case.
