in my case it is minor, just some 5mm around as i remember... but still it should not be like that, and probably it is just a time to continue.

Since this is a cosmetic and not a safety issue, that's a safe bet. IF enough people had the problem to warrant a settlement that put several million dollars in a law firm's pocket, then maybe a firm would take it on contingency. Otherwise, the cost to hire a firm would be far more than the cost of everyone just paying the dealer to replace them. Now, if OTHER VAG vehicles suffered the same problem, or a safety issue was identified, and there were enough class members there might be shot. In addition to VAG, the glass manufacturer could also be named as a defendant. Further complicating the matter is that the residents of each country would likely have to file a suit in their respective countries and the outcomes might not be consistent. Since this thread started over 8 months ago I suspect the OP hasn't been successful in retaining counsel.

Do you think an attorney could successfully argue that the reduced visibility is cause for a safey concern?

Unless it affects the windshield, no. There is no requirement for rear side windows or even a rear window. Front side windows would have to be degraded beyond what window tint would do to be considered a problem.
EDIT: Even if a safety issue could be proved, it could be argued that any vehicle over 15 years old - and well beyond the warranty period - is subject to wear & deterioration requiring its owner to renew various parts without recourse to the manufacturer. Frankly, I don't think any attorney would touch this claim.

Options:
1. Live with it.
2. Fix it.
3. Sell it.
