update on the accident

apparently the truck driver's insurance is claiming the CGT owner is at fault (for stalling it) and the CGT owner's insurance is not paying either because they would not have underwritten the car anyway. iow, the insurance company is claiming that since they would not have insured the car anyway, the normal 30 days to add the car to his policy does not apply.

In most states insurance law requires insurance companies to cover the name insured for Liablity (3rd party claims) for 30 days without the insurance company actually being notified. Sadly, for first party claims, the named insured's claim for damage to his own car, property, does not apply...The time period for automatic coverage for comprehensive/collison coverage is much less if at all without prior notification to the insured's insurance company. Sounds like a suit is in order against the trucfk driver's insurance company...Sad story...
