Audi vs Drunk Driver

I thought I'd post this over here as well, just so we can be aware of the carelessness of some of the other drivers on the road.

Well I got blasted on my way home from work Friday night. Happened on I-5 northbound about a half a mile from the Olive street on ramp. Was in the far right lane when I get basically T-boned from the left on the freeway at 60mph.

Car went into a spinning out into traffic and then towards the wall. Did everything I could to regain control and not hit anything. After about the 3rd spin, I had it back in my hands. Coasted off to the side of the road, and saw the f*cker that hit me trying to take off. My car wouldn't start, but someone did follow him and guide the cops into his arrest. He was twice the legal limit, and will be charged with a DUI and hit and run. Unfortunately for me, the cops did not find any current insurance in his car

I was taken to the hospital and got to spend the night at Harbor View. I get to wear a sweet neck brace for the next few weeks.

Here's a picture that my dad took with his phone when picking up my belongings from the car. I'll try to get some other photos later.


To me, it looks like it will be totaled, but lets try to be optimistic.

Ouch, I'm sorry to hear that, but most importantly you are ok. I hope they figure out the insurance for you.

Glad to hear you're alive and doing relatively well. Try to use the neck brace as a sympathy card at your favorite pick up joint! Hope the drunk gets the book thrown at him.

That sucks. It looks totaled to be honest. At least you only got minor injuries, could of been worse. Get the proper treatment you need! I'm still getting treatment from when I was hit in May 2010.

glad you're okay, the car can always be replaced... but it's incredibly frustrating that there are people like that driving on the road, who don't care if they hurt, injure, or kill those around them.

Wow ... So glad that you were in a safe car. No insurance, drunken driving and distracted driving ...the trials and tribulations that we and our cars go through these days as part of the daily commute is just too much.

Thanks for the kind words everyone. I too think it will be totaled. I couldn't even get out of the driver side door, had to be pulled out through the passenger side. So there is probably more damage there that we can't see. Anyways I've already started looking at replacement cars.

I was very lucky in this case. If he had hit me about a foot farther towards the front, sending me into the wall, I would probably still be laying in the hospital. Some people are not as fortunate as me.

Thats horrible! I have a feeling its going to be quite sometime before my neck is back to normal. Tried driving today and it just wasnt happening.

Neck injuries are the worst from what my chiro has told me since most of the nerves travel from you neck/spine down.

I felt fine the day it happened, but the next day I had a lot of back/neck pain.

Glad to hear your ok and hope you will have a quick and full recovery. My close friend was also hit by a drunk driver Friday night on the Westseattle Bridge he’s doing well just a small cut to the back of his head other than that he’s good.

Hopefully you have good UM coverage (uninsured motorist coverage) for both property damage as well as bodily injury. If you don't, make sure and add it to your coverage just in case there is a next time-I'm seeing a TON of uninsured drivers causing accidents these days.

Yeah, I upped my limits as well.. tons of people out there with no insurance these days.

Glad to hear you're ok!!! Audi's are tough!

I'm fully covered on both. There's way too many people out there that do not give a damn about human life. Spoke with the adjuster today, we have to wait for the Washington State Patrol to release the report before we can make our next move.

On a side note. Many people have been telling me that I should take some legal action and sue the pants off this guy, however the way I see it, if the guy doesn't even have insurance, what are the chances of him having any money to pay for my pain any suffering? Any other opinions on legal action?

Well, you can't get blood out of a turnip. Most guys rolling around without insurance don't have assets to go after. Make sure you send in the DOL form advising them of the fact this guy is driving without insurance. IF he has a valid drivers license, once they are advised of the accident there is a good chance they will suspend his license...his DUI will most likely result in him losing his license as well.

If you have UM coverage this covers the pain and suffering-essentially it puts your insurance company into the shoes of the third party...don't expect them to treat you fairly just because it is YOUR insurance company-the screw job works even better sometimes when you don't see them coming. Once you do reach a settlement with your insurance company they will probably pursue a recovery against the driver who caused the accident.

If he was charged with DUI, then I would also make sure that you are in touch with the Prosecutor's office to advise them you suffered injuries as well as property damage. The Prosecutor will most likely contact you for an amount of damages suffered for restitution purposes. Unfortunately, criminal restitution does not allow for pain and suffering, but it does include medical bills and property damage.
