Thumbs down Found cracks on my RE050A Bridgestones!

Found two cracks on my right rear while changing my oil yesterday. The cracks are on the seam that separates the sidewall from the tread on the inside wall of the tire. One is about 2.5 inches and the other is about 1/4 inch big about six inches away from the larger one on the same seam. Purchased thru dealer who picked them up from Tirerack.com warehouse in Shreveport, LA. These were dealer mounted and installed in late August of 2006. I only have 9012 miles on them and check my pressure religiously every week.
The question is, who's going to pay for a two tire replacement? The tire is clearly a defective tire and if I change it, the other tire has to be changed out too because it will have more than 30% tread wear compared to the new tire. Damon, what do you suggest to do? Is this tire safe to continue to drive on for awhile longer or should I stop driving it until the tire gets changed out? Here's some crappy cell phone pictures of the cracks.
