That is a pretty tough situation. After telling a person to get off of your car, and then they refuse, really limits what your next options are. You either have to enforce your words or eat them. Neither one sounds good.

If it were me, undoubtedly, I would be pretty angry. However, I don't think I would take it to the realm of physical contact unless I was pretty confident that I could take this guy AND I was out of my mind, stark raving furious. And if that were the case, I think I would probably start by shoving him off of my car onto the ground, probably out of sheer fury.

Not pursuing it past verbal confrontation would be hard to stomach, but would probably be the smartest and safest thing to do.

In all honesty, since I'm not very big, and have a lot to lose if I got hurt, or worse yet.....hurt someone else, I would probably just watch them very closely to make sure they aren't hurting my car, and try to politely ask them not to lean on my car, even though I would be pissed.

I go to SOBE every vacation and i hate the place due to tourist like that ! you did the right thing its your property protect it but it sucks to to be able to leave you car and not worry about it. I know the feeling

Things like that really **** me off. Some people have no respect for personal property. Reminds me of how people feel that its ok to just walk over and sit on my bike to see how it feels. Maybe I should have bought a cruiser instead so this wouldn't happen.

It's really a function of your confidence in your personal capabilities. I really think, after asking and warning, that it's well within your rights to take matters (literally) in to your own hands. The world (IMHO) has become waaay too PC about these things. If someone wants to step on your property rights, then they have to be prepared to defend their position.
I don't condone coming up behind them and whacking them in the head w/o a warning, but once warned, as long as you want to take the personal/physical risk, go for it. It's the absence of these responses that increasingly give thoughtless people the sense of unchecked behavior.

Have you ever been to court for street fight?

He gets hurt --you both go to court.
You get hurt - you both go to court .

Then add to the mix lawsuit , expense, and the all the headaches of a he said/she said drama.

All this over a guy sitting on his car ? Not worth it .

I understand that the effort to prove wrong or right can have an emotinal base but at least try to avoid it in the first place .

Ocean Drive might be a fun tourist site for the beach or a walk but it really lacks the class that is projected in the media . There are much nicer places on South Beach . He could have parked off Lincoln Road walked the street and could have even had a bite at The Delano . It's a different crowd .

Parking is better , resturants are better , crowd calmer. shops more upscale , and even the women are prettier (just my opinion) .

No, I can't say that I have. And you point out a valid risk. I guess one has to ask oneself where to draw the line. Sitting on the car? Taking a key to the car? Hammering on the car to break in?
Are there any cases in which you'd take matters in to your own hands? Not saying you should. Everyone's psyche is different, priorities different, abilities different.
I DID grow up in a place (inner city NY - but in a time in which fists were the likely weapon of choice, not guns) in which a street brawl was not uncommon. I've been my share. Never the initiator, and not often the winner. But you had to stand up for what you thought was right and/or defend yourself. For your own health and well-being, as well as sleeping well at night knowing you did the right thing.
This is all far-afield of someone buffing your fender with their bottom, but there is no clear line. Just my opinion.

In 1994 I caught a guy sitting in my brand new 1995 993 . From a distance he looked like a teen as the car was parked at a school which has security as well as a police officer . He was not a student but a professional theif about to steal my car at 10 AM on a Tuesday.

I did run up towards the car saying "hey what are you doing?" He jumped out and dove into another vehicle which I did not even see . With another driver they almost ran me over . No licence plate was on the other car .

Since he was well dressed and clean cut the security thought he worked there . He had even waved at them .

The police as well as security were very supportive of my car's ignition destroyed and door lock . The theif was never caught .
I consider myself lucky --the car wasn't taken . No one was hurt.

That's always the best outcome .

One can't control what others do but he can control his reaction to them .
The original poster had every right to request that his car be left alone .

Whatever excuse the other guy makes could be met with "no means no" but to risk escalating a dispute is too great .
