Now for the real question... What happens if it happens again??? Will they have repeat customers having more the one trans put in the car over the span of the next year or two?

The cust would have to be very very unlucky, which means it will prob happen to me!

Seriously, if that happened, the customer (at least in CA) could elect to Lemon Law the car and force a buy back (because the cumulative down days would be > 30).

In the real world, I'm sure Nissan would REALLY be looking for a reason to deny coverage. That said, a bad solenoid is a bad solenoid Good luck proving how that is caused by anything other that a defective part.

Congrats Chris, I know that had to be a relief especially since the car has mods on it.

This does toss out the tranny failure by abused cars only though. And with only 6 months past since the car was released here it could very well just be the beginning based on the tuners findings on the solenoids. I have to doubt Nissan will take many more cars that have Cobb AP and other mods on them as more power can be directly related to tranny failure.

As I recall, same thing happened with BMW's waranty issues on the E46 M3's engine bearing failures.

First, BMW denied all claims, then after a few months of internet discussions, BMW took a more reasonable position.
I was caught in that with my '01 M3. BMW was blaming drivers of mechanical overrevving which which they said caused the bearing losses. This one fellow began to gather together all the shredded engines and found a good portion was coming from M3s with SMG transmisssions. These transmissions electronically stop any mechanical overrevs. When that point was made, BMW backed down and found the problem, insufficient oil delivery at the 8000 rev redline that BMW was bragging about. With engine replacements, redline was 7600rpm. Top end was always weak in the M3 engine, and BMW pushed the redline too far. However, they would not pay for these shredded engines until the point was made about SMG mechanical overrev control. BMW never admits to mistakes, it is always the driver's fault. I had enough of that crap and jumped to a porsche tt.

The 1500rpm launch control on the M5 can't even be called launch control. I had a lot more fun in that car just pressing full on gas immediately. Of course the 0-60 times were horrid because it was all wheel spin, but it did make for a fun show.

On germancarfans they are reporting that all ECUs will be updated and LC will be modified. All new cars are getting them from the factory and everyone else who comes in for warranty work will get the updated ECU code.
