I think the driver was a total moron, who shouldn't have driven over the Cop's foot. Having said that, the Cop wasn't exactly on his best behaviour. The Cop is not going to get $10M out of this.

Add filing a false personal injury claim to the list of charges against P.O. Recio. And FWIW, the Plaintiff's attorney cannot motion for increased criminal charges. The ADA assigned makes that call.

Why can the Cop sue him??? Wouldn't the City ( where the cop is employed) sue the motorist if there was some negligence type stuff going on ??

NYC has no standing to bring the claim. It didn't suffer an "injury". P.O. allegedly did. It's rare that it happens because most defendants who cause an injury to a P.O. don't have deep pockets so there's no point suing them after they're injured. Guy driving Ferrari who can afford Ben Brafman to defend him apparently does.

If the cop was injured, he would have reacted by moving his foot back or something. He says "stop" but obviously the car wasn't on his foot if he was telling the guy to stop. Then the driver moves what looks to be about 1" and that's enough time for those giant wheels to completely roll over his foot? I'd estimate a good 6-9" roll would be needed to roll over his foot.

The cop then slams the window, swears at the guy, uses way more force than is necessary, and proceeded to put tremendous weight on his "run over" foot, using many of the foot muscles, while he maintained his balance while throwing the owner onto the ground.

The Ferrari kid was a dick, no question, but that's absolutely not how you treat another harmless human being.

What a joke.
