I spoke with the deputy finance administrator who took it to her boss. I guess they looked at the pictures and felt it was the city's responsibilty not to endanger property with a condition like this. This really is not like curbing a wheel. The closest situation I know of is a concrete contractor who reimbursed a few car owners who suffered wheel damage from an excessively high entry lip to an entrance driveway to a fast food restaurant nearby. I hit the bump and thought I jumped the curb, but then saw I entered properly but the lip was way too high. Fortunately I had no damage.

as far as responsibility, havent you guys heard of the burglar who fell in some guy's home and sued and won damages for some property fault that caused his injury? there is a reason why everyone should have an umbrella policy to their homeowners/auto insurance.

but fundamentally, in this society, you are expected to maintain reasonable safety standards on your property whether it be public or private. is it right? im not sure. but in functionality, it is what our society demands.

good luck with the repair, though. i cant imagine how annoying the whole ordeal must have been.

The bumper cover was reinstalled and looks as good as new except underneath where the plastic was stretched when it was pulled off by the rebar, and required a few more screws to fix it back up and prevent this from happening again. No other way to deal with this other than replacing the entire cover, which really isn't necessary. It looks perfect to the eye and is a leased car anyway.

I have trouble with this comment, my property is highly wooded and on a slope covered with substantial rocks. Your telling us that should a burglar come through there to rob my house and instead falls breaking a leg, I'm responsible? Since they shoot horses with broken legs, is that my recourse?

The Burglar story is an urban legend. However, there is a famous case referring to a spring gun. In essence, a man booby trapped his home to shoot someone if they broke in. That is illegal. At any rate. We have building codes, laws and and responsibilities to guests. It is my guess the city was aware that there was a building code violation or some other problem.

The City of Chicago reimburses some people for pothole damage sustained. Not in every case, but in some. How do I know? Well, I am a lawyer who has appeared on TV discussing the very topic.

In the end, glad your car got repaired. Events like that are disheartening...and cause a mix of emotions. Like--Damn I am an idiot. WTF, who would leave the rybar protruding like that. Why wasn't that fixed earlier?

Case closed...glad it went well for you.
