Title problem

Title problem

I'm a non resident in the US, I visit a bit though as my partner lives in the US. Here in lies the problem, I purchased my TT a few years ago for a drive car when I'm here. I stupidly titled the car in her name as she was a resident and could add it her insurance etc. I'm the sole driver of the car, have possession of the vehicle and have proof of payment for the car and servicing etc records. Now of course I'm splitting with her and she won't sign the car over. I'm totally unfamiliar with the US legal system and any rights I may have in relationship to the car, has anybody got any practical advice besides being nice to her again?

which state is the car registered, and which state did she live in? It's pretty much a state by state basis.

I have seen cases like this on Judge Judy; the judgement almost always goes to the person's name on the title. Sorry, good luck.

It's registered in VA, which is where she is domiciled.

Hopefully some lawyers can add some input...

I had a similiar situation (almost identical) in that my old 02 Carrera was titled in my ex's name...(I tried to register the car but had some umm...drag racing issues to take care of)

We were good friends prior to the relationship so she signed the title, check was made to her, and she signed that over to me also.

In hindsight, it was a dumb move to put an asset in someone's name, but I guess you don't think that far when you trust them.

Good luck in the situation...hopefully after she cools down, she will sign the title and give it to you...otherwise, it's not so bad man, you'll have a TT forever since you cant sell it!

We're using Judge Judy as a basis for legal advice? Note that that's arbitration, at that point.

But, in fairness, I think you're right. rosesplus, I'd be out of my bounds giving girlfriend advice - but, uh, be nice to her and get a good lawyer! Sorry to hear about this, man..

... until you meet someone else, she gets really pissed, and then reports the car stolen. Jail time ensues, etc. I'd call a lawyer, but the cheapest thing to do would be to work it out with her. Offer her $1,000 just to sign the thing over. It'll be worth the expense in the long-run. (Note that most states will make you pay tax when you transfer the car, though.) If you just broke up yesterday, I'd let her cool off before pushing this any further. Hopefully cooler heads will prevail, and she'll sign the car over to you for free. I think Sales Tax will be more of an issue, though.

When you watch enough JJ, you do learn a few things here and there. The best advice is talking to a lawyer, which someone already given. Just want to prep him that he may not see his car again.

For the OP, be nice to her + ... maybe $5000???
