You need to make sure there is a police report filed and as said above if at all possible get the other person ticketed. Additionally, you need to tell the insurance company you want diminished value for the car. This is something that insurance companies DO pay out, but try to keep it low key.

If she got transported by an ambulance there will be a police report with everyones insurance info (at least that's how we do it here). on the other hand some local (city) cops don't even show up to crashes if someone denies the ambulance, in that case you'd probably want to go to the station and file a report. we usually don't cite out of crashes, just fyi.

Sorry to hear about your wife's accident hope all is well. My wife was hit last year by a beat up car with and the driver did not have a license... Later claimed she was not at the scene. Fortunately good doc and pictures got us paid for the damage although there was some hassle.

Advice #1 most important:
- DON'T talk to the other insurance company!!!! Also tell your wife.
They may call and harass you, ask for a statement, find discrepancies in what you say on phone and what you reported to your own insurance company, they call and ask really friendly and caring "how are you" (normal answer in business days are "good, how are you". Good might be the wrong answer when you are hurt from the accident or the car is in pieces and you have no transportation.
Refer 100% of the time that you gave your statement to your own insurance company. If they keep pressing just finish the call and say, "My insurance company has all the info you need, talk to them, bye."

OK folks I just saw the car & the damage is minimal ,visually right side fender seems to be only damage.It will be interesting if there is any frame damage. It looks like the wifey should be fine. Sean be sure to keep everyone updated.

Fron whats been said here so far and the info we have, it sounds like the other guy was at fault. Or at least majority at fault.
I don't know all of the details of the accident though.
Remember, just because the other guy receives the ticket from the police, it doesn't mean that they're totally liable for the accident, or that they have any liability at all. It just means that the ticketed party was doing something illegal at the time of the accident.
If we know the totality of the circumstances surrounding the accident, a more accurate liability assessment could be made.
As far as giving a statement goes. I would wait until your wife is out of the hospital and is in a better physical and mental state to give the statement. But, as long as she's honest about what happened and the other guy was truely at fault, there shoudn't be any issues with giving the statement.
