My wife was just hit!
Update: My wifes C4 and 5 discs are compressed and she is still having regular pain. She does have a lawyer and she is seeing a chiropractor 3-4 times a week. Her FP sent her to see a surgeon as well but she is very much afraid of surgery and it will be a last ditch option.
As to my car, my insurance comp (Amica) low balled the estimate, cutting me a check for $15K. However Sunil at Motorwerks said that there was much more extensive damage...especially major frame damage (so bad even the roof was bent) and furthermore, the engine is toast.
However my insurance company is refusing to believe that the engine is really damaged...is it time for me to lawyer up as well?
I am posting here because this is where all my Houston homies post and I need some quick advice.
My wife was just hit while driving the E350. She seems OK but I am heading out to meet her at the Docs office. First things first is making sure she is OK.
It was the other ladies fault and the E350 was heavily damaged.
Any advice will be appreciated!

2. You say it was the other lady's fault, was there a cop/investigator on scene? If you have the right documentation from a law enforcement official than it's a clear case. Her insurance will take care of your vehicle regardless of what insurance you have since it's her fault.

Insurance companies are getting tricky these days. I had an accident sometime back & the other driver was ticketed. His insurance co. only agreed to pay 70% because I had a car phone & they stated I could of been distracted, therefore, I was partially at fault.

Sorry to hear Sean... I hope your wife is uninjured. Assuming that is the case you will at least have monetary damages with the car and possibly time lost from her work/medical expenses that the insurance company will not want to pay. I have had some experiance with this senario in the past.

Track everything. Mileage to and from Dr. To and from repair shop. To and from getting meds. Track time missed from work. Documentation will be key. Be nice to all parties and be vague on answers to the other parties insurance. Leave wiggle room. Take pics of injuries and damages to the car. Pics help if you ever have to go to court. Take good close up pics.

You need to make sure there is a police report filed and as said above if at all possible get the other person ticketed. Additionally, you need to tell the insurance company you want diminished value for the car. This is something that insurance companies DO pay out, but try to keep it low key.
