IMS Class action lawsuit
#16
This is going to seem like a silly question and probably is... but the settlement and 25% refund applies only to the actual person who paid for the repairs and not the current owner correct? i.e., my previous owner did the whole IMS retrofit and other things and I have receipts and all the paperwork, but car was not in my ownership at the time. This doesn't help me does it?

Got my paperwork a few days ago, but have not sat down to read it. I thought I saw something that stated if you did not reply you would automatically be removed from the class action. Meaning that if you did not reply and had an issue in the future you would be on your own to seek compensation regardless of the outcome of the class action.
Again I only glanced at it for a few minutes last night so if someone has theirs handy feel free to corroborate or correct what I wrote above.

Logic?
I need help understanding the logic of this settlement. It covers cars manufactured from 2001-2005 however, excludes cars that are 10 model years old as of the settlement date. This automatically excludes the cars manufactured from 2001-2002? WTF? This does not make since to me. Am I reading it correctly?

The limitations on age were a bit baffling to me also. By the time I received my paperwork, my 2002 C4S was already excluded due to age. Fortunately, my IMSB never failed. I had it proactively replaced with the LN Engineering ceramic IMSB at about 125K miles just to give myself a little bit of peace of mind.

I threw it away concluding my '02 wasn't covered. Three things I've read, but don't know if they're true:
1. In the original suit, it referenced that less than 10% of engines were affected? - Wonder how many were made?
2. Failure occurred significantly less in Tiptronics.
3. If you're over 100K miles by now, you probably don't have to worry about it. - Hope that's true...
