that's a very good deal. from what i've read and heard most M5s like that are selling for low 50s at auction. closer to 60k from a dealer. assuming it checks out I say go for it, but if it's an SMG be weary, because if anything goes wrong with that tranny it'll be a wallet-buster to fix it.
EDIT: now that I see it's a lemon that's not enough of a deal to me. I'd think about it for 40k.

Car shows in service date of 02/05/2006. That means you would have warranty for a little less than 2 more years. It was reported as a lemon back in January 30th of this year.
I'd be curious to see what was wrong and supposedly fixed.

Unless you intend to keep that car into perpetuity I wouldnt buy it. You will never be able to dump it and if you do you will take a greater bath than the dealer is now.
And the buy it now price is rediculous on a buyback car, I bet the dealer bought it in the 30's. Most 06's are in the low 50's right now at highline sales and some are in the 40's. The lemon title drives that price even further down.
Once the warranty is up, you are SOL too as you cant buy an extended warranty on it. And good luck finding a bank to finance the branded title- and if you dont need financing whoever buys it from you might and branded titles are not accepted by probably 95% of the banks out there.
Keep shopping and you will find a deal on car that isnt branded.

I've had zero problems with my 06, but i know there were many examples with problems. I wouldn't buy a lemoned car especially not at that price. Not a good deal. For 20k i'd consider it.

No, you cant lemon a lemon. Only new cars (in California) are eligible to fall under the Lemon Law.
Thanks for the opinions guys, as matter of fact, I was little too excited as well, after checking its carfax I found out it's lemon and backed out immediately, I guess it'll take some time, if anyone wants to sell their M5 pm me thanks.
