That's a really nice tail and as you said "smaller, more sleek interpretation".
I wonder if both had to discontinue due to some design infringement of Porsche's ducktail? There's another out there but it's almost $2k from EVS.

I don't think so, but for a small company JUST the cost associated with going to court would be enough to make them think twice about picking a fight with a large company with huge resources.
Harley Davidson tried to trademark the sound of their bikes. They took all the Japanese companies to court. I don't know how it ended up though.

More famously, Harley-Davidson attempted to register as a trademark the distinctive "chug" of a Harley Davidson motorcycle engine. On 1 February 1994, the company filed its application with the following description: "The mark consists of the exhaust sound of applicant's motorcycles, produced by V-twin, common crankpin motorcycle engines when the goods are in use". Nine of Harley Davidson's competitors filed oppositions against the application, arguing that cruiser-style motorcycles of various brands use the same crankpin V-twin engine which produces the same sound. After six years of litigation, with no end in sight, in early 2000, Harley Davidson withdrew their application
Doesn't make sense really. There are plenty of other "style" spoilers out there. Why hammer on the "duck tails" when there are plenty of GT3 "style" or GT2 "style" products available.

Porsche does things that are at times baffling, but my guess is that the Ducktail, especially this one that pertains to the very limited Sports Classic 997, is quite exclusive to this model. I guess they want to maintain that exclusivity. In comparison, the GT3 and GT2 are not as exclusive. My uneducated guess.
